The Public Prosecutor’s Office has filed its indictment with Investigating Court No. 5 of Las Palmas de Gran Canaria against a food-sector sales representative for an alleged fraud offense. Prosecutors are seeking two years in prison, disqualification from standing for public office for the duration of the sentence and payment of the trial costs for the accused, identified as JJPA and known by the nickname ‘IP’.

The events date back to December 20, 2019, when the accused worked as a sales representative for the Galecan group, a company engaged in the wholesale trade of fish, seafood and other food products. According to the Public Prosecutor’s representative in the provisional conclusions, the defendant used the company’s official email account to place a major purchase order with a supplier.

The order consisted of 7,400 kilos of perch for a total amount of €32,724. The goods were personally delivered that same day by a refrigerated transport company in the Jinámar district. The prosecution alleges that the sales representative acted with the intention of obtaining an illicit financial benefit, knowing that the seller would not receive the agreed payment.

To carry out the deception, the defendant led the supplier to believe that the transaction had been approved by Galecan’s management and that he was formally handling it in the course of his duties. The investigation established that the purchase had not been authorized by the company. The employee’s ultimate aim was to take possession of the fish and sell it independently to third parties.

The fraud came to light when the affected party formally demanded payment of the invoice, first from the sales representative and subsequently from the company. After payment for the goods was not made, the injured party launched legal proceedings to recover the money, seeking the full repayment of the defrauded amount.

The Public Prosecutor’s Office classifies the conduct as a completed fraud offense and identifies the accused as the direct perpetrator. The court filing also states that the victim must be compensated in the exact amount of €32,724 as civil liability, together with the applicable statutory interest.

The defendant has a criminal record for road safety offenses handed down by courts in Santa Cruz de Tenerife between 2015 and 2017. These previous convictions do not constitute repeat offending because they do not fall under the same title of the Criminal Code. Consequently, the Public Prosecutor’s Office finds no circumstances modifying criminal liability in the case, for which the opening of the oral trial has already been requested before the Criminal Courts.
