Right to Information
In compliance with the applicable legislation on personal data protection, and with particular regard to Articles 12 to 14 of the GDPR, you are informed as follows:
The Data Controller is GOBMED CANARIAS, with Tax Identification Number J76100965, registered office at Calle Buenos Aires, 3, Offices 1-2C, 35003 Las Palmas de Gran Canaria, website canarymaritime.com and contact email address contacto@canarymaritime.com.
The personal data provided by Users through the Website shall be processed for the purposes specifically stated in this Privacy and Cookies Policy and, where applicable, in the various data collection forms made available on the Website. In this regard, the collection of data through the Website serves the following processing purposes:
To enable Users to browse the Website, thereby allowing access to the information and content made available on it.
To respond to specific requests and enquiries submitted by Users in this context.
To adopt any protection measures applicable under current legislation, including the possible anonymisation of personal data using appropriate techniques available for that purpose. Accordingly, anonymisation and pseudonymisation processing may also be carried out in this context to improve the protection of personal data.
To apply the relevant technical and/or organisational security measures to Users’ personal data, taking account of the risks identified at any given time in relation to their rights by GOBMED CANARIAS, including the encryption of personal data and other measures that may involve certain processing of Website Users’ data.
If you do not agree with these processing purposes, you are requested to leave the Website immediately. Otherwise, for example by accepting this Policy or simply continuing to browse the Website after becoming aware of the information contained herein, the User shall be deemed to have given unequivocal consent to the processing purposes previously described. For these purposes, regard must also be had to Section 4 of this Policy concerning consent and Users’ rights in this area.
The legal basis for processing is principally the User’s consent. Once the User has been informed of this Policy, acceptance of it, or simply continuing to browse the Website, shall be understood as the giving of unequivocal consent to the processing of personal data for the stated purposes. Accordingly, if a User does not agree with this Policy or the processing purposes communicated, as already stated, they are requested not to continue browsing and to leave the Website immediately. Where Users specifically request or contract certain content, products or services through the Website, the primary legal basis for processing shall be the taking of pre-contractual measures at the request of the data subject, where applicable, or the performance of a contract if the User ultimately contracts the relevant content, product or service.
As a general rule, personal data collected from Users through the Website shall not be transferred, without prejudice to cases in which such transfer is mandatory under a legal obligation in accordance with Article 6 of the GDPR. Personal data may also be processed by third-party processors, who shall receive the data for a lawful contractual purpose and shall be required to observe the same level of rights, obligations and responsibilities.
Outside these cases, Users’ personal data shall not be transferred to any other third party unless the User has given consent or another lawful basis for processing applies, including compliance by GOBMED CANARIAS with a legal obligation.
As a general rule, no international transfers of personal data are envisaged. If any such transfers are carried out, the necessary measures shall be adopted in accordance with the GDPR.
Pursuant to Article 30 of the Spanish Commercial Code, where the User is a customer of GOBMED CANARIAS, their personal data may be retained by GOBMED CANARIAS for six years following termination of the relationship between the parties. Where the User is not a customer, their User data shall be retained for the period strictly necessary to enable proper browsing, access to and enjoyment of the content, products and services made available through the Website that the User requests or visits, in accordance with this Privacy and Cookies Policy and the legislation applicable in each case.
You may exercise your rights of access, rectification, erasure, restriction of processing, data portability and objection by sending a written communication to contacto@canarymaritime.com with the reference “Exercise of Rights”, enclosing a copy of your national identity document or equivalent identification document, such as a passport or foreign national identity number. If you believe that your rights have not been properly addressed, you may lodge a complaint with the competent supervisory authority, in this case the Spanish Data Protection Agency.
Consent of the Data Subject
By accepting this Policy, the User gives their unequivocal, freely given and informed consent to the processing of their personal data for the purposes described in Section 3 of this Privacy and Cookies Policy. In the specific case of cookies, particular regard must be had to Section 7 of this Policy.
The User shall have the ability to choose the processing and destination of their data according to their specific interests and needs in each case. Where processing is based on the User’s consent, the User shall have the right to withdraw it at any time, although such withdrawal shall not in any way affect the lawfulness of processing carried out by GOBMED CANARIAS before the withdrawal.
In all cases, GOBMED CANARIAS may prevent use of the Website and its associated services, content and functions where the User does not accept this Policy or does not consent to the processing of their personal information in accordance with it.
Acceptance of this Policy is independent of any acceptance of specific legal terms and conditions that may govern the contracting by Users of services and products made available through the Website.
Security
GOBMED CANARIAS has adopted and implemented the levels of security required by applicable legislation in respect of personal data under its responsibility, based on the corresponding risk-based approach, and endeavours to install and/or implement additional technical or organisational protection measures in order to strengthen the overall security of personal data processing, systems, the communications environment and the corporate organisation, as well as to ensure appropriate protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, in accordance with the principle of integrity and confidentiality. Nevertheless, the User should be aware that security measures on the Internet are by no means impenetrable and depend on the state of the art at any given time and the cost of implementation.
For these purposes, particular consideration shall be given to the applicable criteria and security measures and other security obligations associated with the GDPR, with special regard to Article 32 thereof.
Duty of Secrecy and Confidentiality
GOBMED CANARIAS undertakes to comply with the duty of secrecy and confidentiality in relation to the information and personal data provided by Users of the Website and under its control and responsibility, in accordance with applicable legislation and the corresponding risk-based approach at any given time.

GOBMED CANARIAS nevertheless reserves the right to amend this Policy in order to adapt it to future legislative, doctrinal or case-law developments that may apply, or for technical, operational, commercial, corporate or business reasons, giving Users reasonable prior notice of any changes where possible. In all cases, Users are advised to read this Policy carefully each time they access the Platform, as any amendment shall be published through it. Where this is not possible, and having regard to the criteria contained in the GDPR for determining the competent lead or principal supervisory authority for any conflict, dispute or complaint relating to this Privacy and Cookies Policy, at least at administrative level, that authority shall be the Spanish Data Protection Agency (AEPD), subject in all cases to Article 56 of the GDPR. As regards the right to effective judicial protection against GOBMED CANARIAS, Article 79(2) of the GDPR shall also apply in such cases, and the relevant action must be brought before the Spanish courts insofar as GOBMED CANARIAS is a legal entity established in Spain. Spanish law shall apply in all cases.
